CIPO issues patentable subject guidelines

The Canadian Patent Office has issued guidelines to its examiners on examining patent applications for patentable subject matter in light of the Federal Court’s Amazon.com decision.

The guidelines include reference to determining the ‘claimed monopoly’ and the ‘actual invention/inventive concept’, terms contained in CIPO’s submissions to the Federal Court of Appeal. The Federal Court of Appeal has reserved its decision on patentable subject-matter in Amazon.com.
