Archimed alleges that in the context of the sale of a condominium unit, real estate broker Marius Man violated its copyright by publishing without right on the Centris website seven photos that it had taken several years earlier at the request of another broker. ... Mr. Man received the formal notice of copyright infringement on February 26, 2024 and on the same day, he removed the seven photos from the Centris site. ... The Court therefore concludes that Archimed has discharged its burden of proving, on a balance of probabilities, that Mr Man infringed its copyright by publishing on the Centris website, for commercial purposes, seven photos that it took. ... In this context, the Court arbitrates at $850 the amount to which Archimed is entitled per photo published without authorization.
