"The applicant has filed a claim against the defendant, Agnico, in particular to have it declared that the latter has committed acts of infringement of the patent of which he is the holder. ... The Defendants are today requesting the rejection of the counter-expertise report dated January 13, 2026, prepared in response to the expert report produced by the defendants. They essentially argue that this report goes beyond the technical framework of expertise and encroaches on the domain of legal opinion. They also argue that it does not meet the necessity criterion established in the Supreme Court's Mohan decision and further argue that its authors do not possess the qualifications or technical skills required with regard to the invention covered by the patent.
