The defendants moved to strike the Statement of Claim on the basis it disclosed no reasonable cause of action. The self-represented plaintiff's Statement of Claim alleges the defendants committed theft of the plaintiff's trade secrets. The Court accepted the argument that the plaintiff having chose to obtain patent protection (which expired in 2011), he had forfeited any right to claim a trade secret. The Court also found that the plaintiff had assigned all rights in the invention to a corporate entity and so the plaintiff had no proprietary interest in the invention.
