This was a contract dispute between an event production company and the lease company for the Bell Center. The dispute arose over liability for SOCAN royalties and particularly which tariff should have applied to the event. The plaintiff event production company had sought to be responsible for the royalties and took the position only a flat fee was required. The lease company had applied and remitted a percentage royalty. The Court found that the event production company had not mislead the lease company as to the applicable tariff since it was not certain which tariff would apply. The court denied the motion to dismiss the proceedings. (Summary based on a translation)
