Oasis Filter International Ltd v Manz, 2025 ABKB 565
2025-09-29
Read full decision. Summary prepared by Alan Macek:
The Plaintiff Oasis Filter International Ltd. claims the Defendants, infringed the Canadian patent owned by or assigned to Oasis. ... Manz and MEL dispute the claims. They argue Oasis had no authority to commence the action. They assert that the Oasis patent is invalid and that the Plaintiffs have failed to prove any infringement of the patent. ... As with Oasis Filter, Manz and Richards were the only shareholders of Oasis with each holding 50% of the shares. ... Richards did not have the authority of the Board of either Plaintiff corporations to commence the litigation. This is something Richards admitted “didn’t occur” to him. ... The Plaintiffs’ action is dismissed.
