"It alleges that Aleees breached its contractual obligations arising from sublicense agreements on a set of international patents managed by LiFePO, in particular those of paying it royalties and investing in Quebec with a view to operating a factory there. ... On August 14, 2024, Aleees filed a lawsuit in a U.S. court seeking invalidation of one of the patents sublicensed under the contractual agreements between the parties, numbered 7601318 (the Virginia case). On September 3, 2024, Aleees filed a motion to dismiss in this proceeding based on forum non conveniens ... Nothing demonstrates, simply because these proceedings exist in Virginia, which concern only one of the patents that is the subject of a sublicense under the contractual agreements between the parties, that the Virginia authorities are better placed to hear this action. The causes of action in each case, although they partly concern the patent challenged by Aleees, differ, one raising the breach of contractual obligations, the other seeking the invalidation of a patent. There is no reason to believe that there is a risk of contradictory judgments if the two cases continue their respective paths in parallel." (based on a translation)
