"This decision concerns a motion by the defendants for increased security for costs, the plaintiffs having previously posted $30,000. … The other significant estimated disbursement is $174,000 in connection with expert witnesses and reports. Leaving aside all of the other issues with this amount, it is premature. On this motion, the defendants are seeking security for costs for the anticipated costs up to the completion of discovery. Costs associated with expert evidence are more appropriately considered after the completion of examinations for discovery. … As a result, I conclude that the appropriate quantum for security for costs to be posted by the plaintiffs is the $35,000 they have proposed."
