CIPO has announced a consultation on changes to the Manual of Patent Office Practice (MOPOP) relating to administrative topics as part of changes to the Patent Act and Rules. Topics covered including filing requirements, divisionals, priority, transfers/assignments, corrections, abandonment/reinstatement, and due care. The consultation is open until May 27, 2019.

CIPO has announced that “all applications will be inaccessible” from 3pm November 1st to 6am on November 5th. This relates to the upgrades needed to support the Industrial Design Act and Regulations amendments coming into force on November 5th.
Patent Pending
My recent article on patent pendency was published this week on Slaw. For patents granted by the Canadian Patent Office in the first half of 2018, the duration a patent application was pending ranged from less than 6 months to over 18 years.
3,000,000
CIPO announced today that it has allocated patent application number 3,000,000. This is the one-millionth ‘New Act’ patent application.
Top Patentees 2016
In 2016, approximately 26,400 patents were granted by the Canadian Patent Office, up significantly from the approximately 21,900 granted in 2015. BlackBerry was again the top recipient of patents, with over twice the patents obtained as any other applicant. Patent Volume in 2016
The number of patent applications published in 2016 or that entered national phase in Canada in 2016 were up slightly over 2015 at about 34,400 application. CIPO Fees
CIPO has opened consultations on proposed fees for various steps under upcoming amended Patent and Trademark rules. These steps include fees per Nice Classifications and renewal fees for trademarks and correction, after-allowance amendments and late fees for patents. The consultation is open until July 5, 2016.

The Canadian Intellectual Property Office has announced consultations on the regulatory framework for patent and trademark agents.
Patent Volume in 2015
The number of patent applications published in 2015 or that entered national phase in Canada in 2015 was approximately the same as in 2014 at about 33,500 application. Smart & Biggar, Gowlings and BLG top the list of firms by volume of applications.
Canadian Trademark Firms in 2015
About 53,000 trademark applications were filed in Canada in 2015. Of these, about 22% were filed in-house or without an agent (about the same as in the last couple of years). Gowlings, Bereskin & Parr and Smart & Biggar were the firms that filed the most trademark applications. Check out my list of the 50 firms/agents that filed the most applications in 2015.
