Order dated 02-DEC-2003 rendered by John Hargrave, Esq., Prothonotary Matter considered without personal appearance The Court's decision is with regard to Letter from Defendant dated 03-DEC-2003 Result: There have been various suggestions as to appropriate dates for this summary judgement motion. There was an earlier Order as to a date. Today the Court received a letter from defence counsel, offering to travel for an earlier hearing date, however that offer does not include advice as to when counsel for the Plaintiffs might be available. Onc of the Court's registrars has made enquiries. The earliest mutually agreeable date would seem to be 12 May 2004. It is unfortunately that the Court is not able to offer earlier date, however the Federal Court does not have the luxury of great flexibility in setting short-term dates. The hearing of the summary judgment motion previously set for 18 March 2004 is adjourned to Wednesday, 12 May 2004, commencing at 9:30 a.m. for a duration of one day...Rule 366 requires the filing of a memorandum of fact and law on a summary judgment motion. The timing of serving and filing of the motion records is set out in Rule 214, however the times allowed under the Rules often prove a little tight for the parties & provide the judge hearing the application with little flexibility for preparation. The Defendants, who bring this summary judgment motion shall therefore serve and file their motion record by close of Registry on 12 March 2004. The responding motion record of the Plaintiffs is to be served and filed by close of Registry on 13 April 2004. Liberty to apply, by telephone, to the case management prothonotary.
