The plaintiff claims that it was entirely successful in its summary judgment motion [see 2024 ONSC 5174] and therefore claims substantial indemnity costs of $26,032.98 ... The damages awarded fall within the jurisdiction of the Small Claims court. Although the plaintiffs also obtained an injunction to protect their copyright and an order to deliver up the offending goods, relief which is not available from the Small Claims Court, the fact remains that this was a seasonal operation that realized modest revenues. ... The plaintiff shall have its costs from the defendant on a partial indemnity scale fixed at $8,000.00 inclusive of fees, disbursements and HST.
