Bauer Hockey Ltd v. In its first motion, the defendant, which I will refer to as CCM, seeks the exclusion of an expert report that relies on information and documents regarding lost profits that the plaintiff, Bauer Hockey Ltd. [Bauer], refused to provide during discoveries as it represented that it would not be seeking damages based on lost profits. ... Both Bauer and CCM bring a motion concerning the reply evidence of the other’s expert, substantially for the same reason, namely that it would constitute improper reply.
Bauer Hockey Ltd. v. Sport Maska Inc. (CCM Hockey) 2020 FC 624May 15, 2020This action involves two well-known skate manufacturers, Bauer and CCM. Bauer obtained a patent for a pattern for a component of skates called the quarter. It is now suing CCM for infringement of that patent. While many issues were canvassed by the parties at trial, two of them are determinative. First, Bauer’s expansive interpretation of the claims of its patent, which would cover a wide range of CCM skates, cannot be accepted. Bauer’s proposed interpretation is not grounded in the wording of the claims or the disclosure. It attributes a purpose other than that explicitly identified in the disclosure. It is also incompatible with the patent’s prosecution history. Second, the patent claims asserted by Bauer are obvious. Making the quarter in one piece, whereas it was formerly made of two pieces sewn together, is not an inventive step deserving of patent protection. Even taking into account the surrounding context, a skilled person at the relevant time would have readily come to that solution. As a result, Bauer’s action will be dismissed and CCM’s counterclaim, which seeks a declaration of invalidity, will be allowed.
Bauer Hockey Ltd. v. Sport Maska Inc. (CCM Hockey) 2020 FC 862Aug 28, 2020The defendant, Sport Maska Inc., doing business as CCM Hockey [CCM], was successful on all issues in an action for patent infringement brought by Bauer Hockey Ltd. [Bauer]. In this Court’s decision issued on May 15, 2020, the issue of costs was reserved: Bauer Hockey Ltd v Sport Maska Inc (CCM Hockey), 2020 FC 624. ... These are my reasons for awarding a lump sum of $2,517,590, inclusive of disbursements. This amount reflects a base percentage of 25% of legal fees, which increases to 50% for fees incurred after Bauer’s refusal of CCM’s offer. As explained below, I am making certain deductions, mainly because CCM failed to produce accurate financial information on a timely basis and unnecessarily duplicated its technical expert evidence. I am also denying Bauer’s request to make the award payable by instalments.
