Justices Moldaver and Karakatsanis, both currently of the Ontario Court of Appeal have been nominated for the Supreme Court. It was also announced today that the Supreme Court will release its decision in Crookes v. Newton relating to defamation liability by hyperlinking on Wednesday.

Some of the intellectual property cases decided by Justices Moldaver and Karakatsanis while at the Ontario Court of Appeal were discussed in a previous post.

The Crookes v. Newton (SCC#33412) case is an appeal from the British Columbia Court of Appeal in 2009 BCCA 392.
