The Federal Courts Rules Committee announced a “global review” of the Rules and invited comments on several identified proposals, as well as any other proposals for changes to the Rules by July 2nd. Some of the proposals include updates on electronic service and filing, incorporating elements from the consolidated practice notices, and expand roles of associate judges.

National Day for Truth and Reconciliation
In recognition of the National Day for Truth and Reconciliation on Saturday September 30th, the Federal Court will only hear urgent motions on Monday October 2. The court issued a Notice to the Parties and the Profession noting that, “due to the current wording of the amendments to the Interpretation Act and the definition of holiday in section 2 of the Federal Court Rules, the Federal Court Registry will still be open for filing on Monday, October 2, 2023, via drop-box and E-filing only” and “Litigants are reminded to include Monday, October 2, 2023, in their computation of time.” October 2nd is generally considered a holiday at CIPO.
Costs
The Federal Court has published for consultation in the Canada Gazette, proposed amendments to the Federal Courts Rules relating to the costs regime. The proposed changes include: i) separate sections for actions, applications, motion and appeals; ii) only three columns (instead of five currently); iii) additional assessable items; and iv) an overall increase of about 25% to costs awarded under the tariff. Amendments to the Federal Courts Rules come into force today – see earlier post. The amendments relate to i) limited scope representation; ii) enforcement of orders; and iii) a series of miscellaneous amendments including to Rule 3.

As mentioned last week, amendments to the Federal Courts Rules are being made, and were published in the Canada Gazette today for:
- miscellaneous changes including expansion to Rule 3 to focus on ‘outcome’ and proportionality rather than ‘determination’, explicit powers to limit examinations (rule 87.1) and a rule specifically for motions in writing at the Federal Court of Appeal (rule 369.2), among other things.
- enforcement of foreign judgments and arbitral awards.
