Pre-grant Compensation
In my latest column for Slaw on patent publication dates, I discuss how the publication date for patent applications can be later than the typical 18-months secrecy period due to processing delays at the patent office. I have found regularly filed patent applications with publication dates more than 2.5 years from the priority date. For regularly patent applications published in 2025, the average secrecy period was about 23 months according to my analysis.
Patent Litigation
I discussed trends in Canadian patent litigation with Tim Wilbur for an article in Canadian Lawyer entitled “Patent litigation in Canada at record low despite capable courts“. I am quoted in the article on the Federal Court’s use of case management and assignment of early trial dates in patent litigation proceeding. The article also includes statistics from IPPractice.ca.
Outage
Unfortunately, there was a significant server outage last week on the system that supports this website and the daily email service. I’m still working on getting things back online. Malware
Unfortunately, the IPPractice.ca website got some malware on Friday which would try to redirect visitors. Thanks to everyone who reached out to let me know. The website has been cleaned up.
Happy New Year
Thank you for another year with IPPractice! Looking back at 2023, I sent out about 490,000 emails to over 2200 subscribers. I included reports on about 150 IP-related court decisions and over 300 new IP proceedings. My most popular post was about the CIPO fee increases that came into force yesterday, January 1, 2024.
Website Updates
Earlier this month, the Federal Court of Appeal updated its website, including the online docket listings to be similar to the Federal Court website. As a result of this change, I have now updated the IPPractice file browser to work again, including from embedded links in the daily emails, and added direct ‘download’ links where documents are available online.
Outage
As you may have noticed, there was no IPPractice email last week. The outage was due to a computer failure but the site has been rebuilt. Today’s email includes all the updates from last week and Monday’s email should be back to normal. Continue reading Outage
