“Regulations Amending the Patent Rules and Certain Regulations Made Under the Patent Act” have been registered and come into force January 1, 2025. The amendments address, among other things, patent term adjustments based on delays during patent prosecution. There are also some miscellaneous amendments. See my earlier post on these changes.

Patent Term Adjustment
Proposed amendments to the Patent Rules were published in the Canada Gazette for consultation to implement patent term adjustment by January 2025. Term may be added if the issue date is more than 5 years from the filing/national entry date, or 3 years from requesting examination, whichever is later, particularly time attributable to the patent applicant. Patent Rules
Amendments to the Patent Rules have been registered and will come into force on July 1st for amendments related to sequence listings, and October 3, 2022 for other amendments to “streamline examination’, including excess claim fees and requests for continued examination. The changes will include a $100 per claim fee for applications with more than 20 claims (see new section 80), and a fee for continued examination after three office actions equal to the original examination fee (see section 85.1).
