Closures

The Federal Court and CIPO will be closed on Monday, September 19 for Her Late Majesty’s State Funeral. Both the Federal Court and CIPO will also be closed on September 30 for National Day for Truth and Reconciliation.

See the Federal Court’s Notice to the Parties and Profession below regarding the rescheduling of deadlines. Note that this holiday may affect the calculation of court deadlines.

Matters set down for hearing on that date will be re-scheduled
subject to the discretion of the presiding judge to proceed for urgent matters. Directions adjourning non-urgent sittings and requesting dates of mutual availability will be issued by the Judicial Administrator. The Court remains accessible to hear urgent matters with appropriate notice

CIPO’s notice says in part:

As a result of the office closure of September 19: (i) CIPO will consider all time limits to be extended until September 20, and (ii) , will be considered a prescribed day for the purposes of section 78 of the Patent Act, section 66 of the Trademarks Act and section 21 of the Industrial Design Act.
