Copyright

An Order in Council has fixed December 30th as the day on which Division 16 of Part 5 of the Budget Implementation Act, 2022, No. 1 comes into force to extend certain terms of copyright protection from 50 years to 70 years after the life of the author.

The Order in Council, 2022-1219 dated November 17, 2022 but only published earlier this week, states:

Order Fixing December 30, 2022 as the Day on which Division 16 of Part 5 of the BUDGET IMPLEMENTATION ACT, 2022, No. 1 COMES INTO FORCE in order to extend certain terms of copyright protection from 50 years to 70 years after the life of the author.

The Budget Implementation Act, 2022 includes amendments to the Copyright Act, including section 6, 6.2, 7, and 9. Transitional provisions specify that the amendments do not revive copyright for works in which copyright has already expired.

These changes are part of implementation of one of Canada’s obligations under the Canada–United States–Mexico Agreement – see Article 20.62.
